Running Tally of State and Federal Court Orders Affecting Rhody Related to the Coronavirus (COVID-19) Pandemic

The state and federal courts that have jurisdiction in Rhode Island have issued a series of administrative orders to address court operations during the Coronavirus (COVID-19) pandemic. The list below attempts to catalog all state and federal court orders that affect Rhode Island practitioners and litigants.

The gist of the orders is, in a nutshell, don’t come to the courthouse unless you really really have to. The RI Supreme Court, at the end of May, created a helpful page that lists a lot of the COVID-19 orders and guidance.

For the federal district court, the main takeaway is that the court will continue to perform its judicial functions, but the courthouse is physically closed. Most work and court business will continues remotely, although some jury trials occurred in Fall 2020.

First Circuit Court of Appeals Notice on its homepage:

Due to the COVID-19 virus pandemic, and in order to protect public health and safety, the sitting of the United States Court of Appeals for the First Circuit scheduled for April 6 through April 9, 2020 is cancelled. Further information regarding the cases previously scheduled for argument at that time will be provided by court order in those cases.

Due to health concerns over the COVID-19 virus, the Clerk’s Office for the U.S. Court of Appeals for the First Circuit will not accept in-person case filings at its intake window, until further notice. Notice from State Court Administrator (Mar. 20, 2020):

As you are aware, on March 17, 2020, the Chief Justice signed Executive Order No. 2020-04 continuing all trials and non-essential matters until after April 17, 2020 in light of the COVID-19 public health crisis. Though the courts remain open to hear and determine emergency matters, the goal of the Executive Order was to limit the amount of foot traffic in and out of the buildings, both for the safety of the public and our employees. Consistent with the Executive Order, please help us to achieve our goal of limiting foot traffic by refraining from entering any judicial building unless you have an emergency matter before a court.

Providence Business Calendar Guidance: although not in the form of an order, the Rhode Island Bar Association sent the following message on behalf of Judge Stern:

“As we continue to take Coronavirus precautions, the Supreme Court has implemented video conferencing software for the Providence Business Calendar. The WebEx® platform allows certain matters, including chambers conferences, to be conducted remotely.
